Welcome to Polymotions ("we," "our," or "us"), accessible via polymotions.com. By visiting our site, purchasing our digital creative products, downloading our tools/assets, receiving advice or tutorials, or enrolling in our online programs (collectively, the "Programs and Services"), you agree to be bound by these Terms of Service.

1. Studio Overview

Polymotions is a creative design studio providing design services, downloadable creative tools, digital project assets, templates, educational online programs, tutorials, and consultative design advice.

2. Eligibility & Account Security

  • Age Requirement: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to purchase and participate in our Programs and Services.

  • Account Access: When you create an account to access member or student areas on polymotions.com, you must keep your login credentials confidential. Sharing your account, login details, or product access with third parties is strictly prohibited and grounds for immediate termination without a refund.

3. Payments, Pricing & Billing

  • Payment Processing: Payments are processed securely via third-party gateways integrated with Wix (such as Stripe, PayPal, or Wix Payments). You authorize these processors to charge your payment method for the full purchase amount.

  • Pricing & Currency: All fees are listed in USD. We reserve the right to update prices at any time; updates will not affect completed purchases.

  • Sales Tax: Applicable state and local sales taxes (including Texas state sales tax where required) are calculated and collected at checkout.

4. Refund & Cancellation Policy

Because our tools, assets, and online programs provide immediate, irrevocable access to digital source files, project templates, and proprietary video training:

  • All Sales Final: All purchases of online programs, tools, downloadable assets, templates, and digital files are final and non-refundable once access is granted or digital delivery has occurred.

  • Compatibility & Skill Level: You are responsible for reviewing software compatibility and system requirements prior to purchasing. Inability to use or run third-party software does not entitle you to a refund.

5. Intellectual Property & License to Use Tools & Assets

  • Ownership: All course curriculum, video recordings, digital tools, project assets, 3D/motion files, presets, scripts, templates, and branding are the exclusive intellectual property of Polymotions.

  • Limited License:

    • Educational Content: Program videos and lesson files are licensed strictly for personal educational use.

    • Tools & Presets/Templates: Unless otherwise stated in a specific product license, downloadable tools, presets, and design assets are licensed to a single user for integration into your personal or commercial client projects.

  • Restrictions: You may not:

    • Resell, rent, sublicense, bundle, redistribute, or publicly host our tools, source files, or program materials on any marketplace, shared drive, or repository.

    • Ingest or upload any Polymotions course content, project assets, or code tools into artificial intelligence or machine learning training datasets.

    • Claim raw Polymotions toolkits or template files as your own standalone products.

6. Tools, Advice, & Educational Disclaimer (Assumption of Risk)

  • Educational & Advisory Nature: All design advice, critiques, workflows, tutorials, and guidance provided by Polymotions (whether inside programs, via consulting, or through digital guides) are strictly for educational and informational purposes.

  • No Professional Liability for Your Work or Mistakes: Polymotions does not act as your insurer, agent, or legal/technical supervisor. You are solely responsible for how you configure, execute, adapt, and apply our tools, templates, files, and advice in your own work, freelance business, or client deliverables.

  • User Errors & Client Disputes: Polymotions is not responsible or liable for any mistakes, errors, bugs, project failures, missed deadlines, client disputes, print errors, data loss, rendering crashes, or financial losses resulting from your use or misuse of our tools, assets, or recommendations. You bear sole responsibility for testing, quality-checking, and verifying any assets or techniques before delivering work to clients or deploying them to production.

  • No Guarantee of Commercial Results: We provide high-quality industry techniques, but we do not guarantee specific career outcomes, client acquisition, revenue figures, or business success.

7. Limitation of Liability & "As-Is" Provision

  • "As-Is" Provision: All programs, tools, software scripts, digital assets, templates, and site content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

  • Liability Cap: To the fullest extent permitted by Texas law, Polymotions, its owners, and affiliates shall not be liable for any indirect, punitive, special, incidental, or consequential damages (including lost profits, lost data, hardware damage, or client claims) arising out of or related to your use of our site, tools, advice, or programs. Our total aggregate liability for any claim shall not exceed the amount you actually paid to Polymotions for the specific product or service giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Polymotions, its owners, and contractors from and against any third-party claims, liabilities, damages, losses, or legal expenses (including reasonable attorneys' fees) arising out of your misuse of our tools, your reliance on our advice, your deliverables to your clients, or your violation of these Terms.
